Protecting FAPE Through Mediation and Due Process Hearings

Mediation and Due Process by an Orange County Attorney

GirlParents and schools often disagree on what constitutes a free appropriate public education (FAPE) for a student with a disability. Because of this, both state and federal law (IDEA) provide for a process to resolve disputes. It is called "due process" and involves an opportunity for mediation, and even informal resolution. In California, a request for a due process hearing must be filed within two years from the date the party filing the request knew or had reason to know of a violation.

"Education aims to give you a boost up the ladder of knowledge. Too often, it just gives you a cramp on one of its rungs." - Martin H. Fischer
